Travel Terms and Conditions

Article 1 (Purpose) These terms and conditions are intended to specify the detailed implementation and compliance matters of the domestic travel contract concluded between I Love Seoul Tour (the travel agency) and the traveler. 

Article 2 (Obligations of the Travel Agency and Traveler) 

  1. The travel agency shall faithfully perform its duties in the planning and execution of travel, including travel arrangement, guidance, transportation, and accommodation, to provide safe and satisfactory travel services to the traveler.
  2. Travelers must actively cooperate to maintain travel order and promote harmony among travelers for a safe and enjoyable trip. 

Article 3 (Composition of the Contract) 

  1. The travel contract shall include the travel terms and conditions and the travel schedule (or travel description) posted on the website. 
  2. The travel schedule (or travel description) must include the travel destinations and tour content by date, transportation schedules, services provided by the travel agency, and precautions for travelers. 

Article 4 (Refusal to Conclude Contract) The travel agency may refuse to conclude a contract with a traveler for the following reasons: 

  1. If individual management is necessary due to illness or physical abnormalities, or if it is deemed that there would be an impediment to the smooth execution of group travel (such as affecting other travelers’ experiences). 
  2. If the maximum number of participants specified in the contract is exceeded.

     

  3. If the minimum required number of participants is not met. 

Article 5 (Travel Costs) 

  1. Travel costs shall only include the contents specified in each travel plan, although private tours are subject to agreement between the parties. 
  2. A 50% deposit of the contract fee must be paid to the travel agency at the time of signing a private tour contract, which may exceed 50% if not including items such as accommodation and airfare on the day of the tour. This deposit will be treated as part or all of the travel cost or compensation for damages. 
  3. Travelers must pay the remaining 50% of the travel cost excluding the deposit to the travel agency by the day before departure. 
  4. Travelers must pay the travel cost by the agreed method, such as by card, bank transfer, or cash deposit. 

Article 6 (Refund Policy) 

  1. For package tours, a 100% refund will be provided if a refund request is made at least 24 hours before the tour start time. Refunds will not be issued for requests made after this period. For private tours, refunds will be issued as follows: 100% refund for requests made at least 72 hours before the tour start time, 50% refund for requests made 48 hours before, 30% refund for requests made 24 hours before, and no refund for requests made within 24 hours of the tour start time.
  2. No refunds will be provided for meals, entry fees, or transportation services not used due to circumstances of the traveler after the commencement of travel. 
  3. In case of a private tour, the traveler must bear the cancellation fee for expenses incurred by the company and costs arising from transportation reservation cancellations due to the traveler’s fault (the cancellation fee will be deducted from the deposit and then refunded to the traveler). 

Article 7 (Changes in Travel Conditions and Settlement of Fees, etc.) 

  1. The travel conditions specified in the contract can be changed only in the following cases: 
  • Inevitably, due to the traveler’s request or local circumstances for the safety and protection of the traveler. 
  • In cases where the purpose of travel cannot be achieved due to natural disasters, civil unrest, government orders, strikes, or closures of transportation and accommodation facilities.

     

    2. If the travel agency changes the travel schedule specified in the contract, it must notify the traveler before the start of the scheduled date. The notification must include the date and content of the change and any costs arising from the change. 
  • In urgent cases such as natural disasters, accidents, or kidnappings, where it is deemed difficult to obtain the traveler’s consent to change the itinerary, the consent form for schedule change according to paragraph 2 may not be required. However, the travel agency must subsequently explain the reasons for the changes and related costs in writing. 
  • If there are increases or decreases in the travel cost, adjustments (refunds) must be made for changes before departure before the travel starts, and for changes during the trip within 3 days after the end of the travel. 
  • If damages arise due to the termination or cancellation of the contract, the part that occurred before the travel must be settled (refunded) before departure, and the part that occurred during the travel must be settled (refunded) within 10 days after the end of the travel. 
  • Travelers cannot claim a refund of the corresponding fare from the travel agency if they are unable to receive services included in the travel cost, such as accommodation, meals, or sightseeing, due to their own circumstances after the start of the travel. 

Article 8 (Transfer of Traveler’s Status) 

  1. If a traveler wishes to transfer their status due to personal circumstances, they must obtain the consent of the travel agency. In this case, the travel agency may condition its consent on the payment of costs arising from the transfer by the traveler or the person receiving the transfer.

     

  2. The transfer becomes effective when the travel agency consents. However, if the travel agency has conditioned its consent on the payment of costs incurred by the transfer, it becomes effective immediately once the costs are paid within the specified period.

     

  3. The travel agency may refuse consent for the transfer due to contractual conditions or other unavoidable circumstances.

     

  4. Once the traveler’s status is transferred, all rights and obligations related to the travel contract are also transferred to the person receiving the transfer. 

Article 9 (Termination of Contract due to Insufficient Minimum Number of Participants) 

  1. If the travel agency terminates the travel contract because the minimum number of participants is not met, it must notify the traveler at least 24 hours before departure for day trips, and 48 hours before departure for trips of 1 night and 2 days or more. 

Article 10 (Start and End of Travel) 

  1. Travel starts from the point of departure and ends upon arrival at the final destination as per the travel itinerary, except when the contract and itinerary are modified. 

Article 11 (Duty to Explain) 

  1. The travel agency must explain important contents and any changes thereof specified in this contract so that the traveler can understand them. 

Article 12 (Miscellaneous) 

  1. Matters not specified in this contract or disputes regarding the interpretation of this contract shall be decided by agreement between the travel agency and the traveler, and if no agreement is reached, in accordance with relevant laws and general practices.
     
  2. For travel to special areas with justifiable reasons, the contents of these standard terms and conditions can be differently stipulated. 

Article 13 (Responsibility) 

  1. The company is responsible for acting with integrity and diligence in the performance of the travel contract and, for the safety and convenience of the guests, it is a principle that a tour guide defined by the Tourism Promotion Act, selected by the company, accompanies them, except for products not specified in the itinerary.

     

  2. If the travel agency causes damage to the traveler due to the intentional or negligent acts of travel practitioners, the company must compensate for the damage.

     

  3. Travelers are responsible for compensating and indemnifying the company for any damages caused to it due to intentional or negligent acts while cooperating earnestly with the travel guide for the smooth progress of the travel.

     

  4. Valuables and personal belongings of travelers are the responsibility of the travelers themselves to carry and store.

     

  5. Valuables and personal belongings cannot be stored in vehicles during travel, and the travel practitioners and the company are not responsible for any losses.
     
  6. If travel practitioners acquire valuables or personal belongings during the travel, they will be stored in the company’s lost and found for 30 days before being disposed of.
